Terms of Service
DONATION POS Ε.Ε. — Last updated: 10 October 2024
A. General Platform Terms
Article X – Donation Collection Services
DONATION POS Ε.Ε. provides payment technology support and digital donation collection services through physical and digital channels, including but not limited to POS, Smart POS, QR Codes, IRIS Payments, Donation Links, Donation Pages, Web Widgets and other electronic payment services.
DONATION POS may act as a technical intermediary for the facilitation of donations on behalf of partner organisations, foundations, associations, non-profit companies, NGOs, religious entities and other beneficiary bodies, pursuant to a relevant contractual relationship. DONATION POS does not collect or hold donor funds; funds are settled directly to the beneficiary organisation by the licensed Payment Service Provider (PSP).
Donations made through the platform's services are settled directly to the beneficiary bodies by the licensed PSP, in accordance with the terms of the respective cooperation agreement. DONATION POS does not collect, hold or intermediate the flow of funds.
Article X-A – Payment Service Providers & Non-custodial Architecture
DONATION POS is a technology platform provider (SaaS) and does not constitute a credit institution, payment institution or electronic money institution, nor does it itself provide payment services within the meaning of Greek Law 4537/2018 (PSD2). Payment transactions (authorization, capture, clearing, settlement) are executed exclusively by licensed third-party Payment Service Providers (the «PSPs»), in particular:
- Viva Payment Services S.A. (Viva Wallet, viva.com) — an authorised institution supervised by the Bank of Greece (PSD2), via Viva Smart Checkout and the Viva Marketplace / ISV (sub-merchant) model;
- Stripe Payments Europe, Ltd. — an authorised Electronic Money Institution supervised by the Central Bank of Ireland, for card-not-present transactions via Stripe Connect (connected accounts / destination charges).
DONATION POS reserves the discretion to select, designate and change the Payment Service Provider (PSP) used for each service, channel or transaction (indicatively: digital donations, POS, subscriptions), depending on the nature of the service, availability, geographic coverage, cost, technical specifications and compliance requirements, without this altering the substantive rights of the beneficiary organisation.
For beneficiary organisations enrolled in the connected account / sub-merchant scheme of the respective PSP, donor funds are captured, processed and settled directly to the organisation's bank account (IBAN) by the licensed PSP. At no stage does DONATION POS hold, control, comingle or have access to donor funds (non-custodial architecture); it receives solely its service fee, withheld by the PSP as an application/platform fee.
Card data (PAN, CVV2, expiry date) is collected, encrypted and processed exclusively within the PSPs' PCI-DSS Level 1 certified environment, using tokenization and point-to-point encryption (P2PE) for card-present transactions, as well as Strong Customer Authentication (SCA / 3-D Secure 2) under PSD2 for card-not-present transactions; DONATION POS never receives, transmits or stores cardholder data. Integration with the PSPs is implemented over encrypted channels (TLS 1.2+), OAuth2 (client credentials grant) authorization, cryptographically signed webhooks and idempotency mechanisms for reliable reconciliation and clearing/settlement of transactions.
Identification (KYC/KYB) of the beneficiary organisation and its legal representative is carried out by the PSP, in accordance with Greek Law 4557/2018, PSD2 and EU AML directives. Acceptance of donations through the platform requires completion of the organisation's onboarding with the licensed PSP, so that settlement is always carried out directly to the organisation, without any retention of funds by DONATION POS.
Article XI – Representations of Beneficiary Organisations
Each organisation using the services of DONATION POS represents and warrants that:
- a) it is a lawfully established and operating organisation,
- b) it is entitled to receive donations in accordance with applicable law,
- c) it holds all required licences, approvals or authorisations,
- d) it bears sole responsibility for the lawful use and allocation of the donations it receives.
Article XII – Commissions and Fees
Upon settlement by the licensed PSP, the following may be withheld by it, before crediting the beneficiary organisation:
- payment provider fees,
- banking charges,
- agreed commissions,
- transaction management costs,
- chargebacks, refunds,
- other lawful charges related to the provision of the services.
Article XIII – Anti-Money Laundering
DONATION POS may request identification data of natural or legal persons and suspend or discontinue the provision of services where required for compliance with Greek Law 4557/2018 on the prevention and suppression of money laundering, or at the request of a competent authority or payment provider.
Article XIV – Limitation of Liability
DONATION POS is not liable for:
- acts or omissions of the beneficiary organisations,
- the use of donations by the organisations,
- delays of banks or payment providers,
- technical malfunctions of third-party systems,
- force majeure events.
Article XV – Governing Law
These Terms of Service are governed by Greek Law. The Courts of Athens shall have exclusive jurisdiction over any dispute arising from or related to them.
